1. ARRIVAL AND DEPARTURE TIMES

You must arrive between 4pm and 8pm and leave before 11am on the day of departure unless alternative arrangements have been made in advance. You must telephone the property manager if you are delayed. We cannot guarantee that keys may be collected outside of these times.

If you are unable to take occupation on the day and time reserved due to delays, illness, personal reasons etc. no refund can be made. Similarly if you have to cut short your holiday no refund can be made for the days unused. If you would like to extend your stay please contact La Manzanilla Homes and we will inform you immediately whether this is possible.

2. CANCELLATION

We understand that circumstances beyond your control may force you to cancel your reservation.

Although regrettable, we hope you understand that while a rental is reserved in your name it is off the market for other potential guests. It may be impossible for us to re-rent the property. For that reason, La Manzanilla Homes has the following refund policy:

30 days after having paid your rental deposit, taxes have been paid for this amount and we will no longer be able to reimburse this percentage (21%). For the remaining amount of the deposit (79%) the following terms apply:

90 days: If you cancel more than 90 days before your scheduled arrival date, you will receive a complete refund of monies paid, less the 21% taxes.

60 days: If you cancel more than 60 days prior to your scheduled arrival date, one-half (50%) of your money will be refunded, less the 21% taxes.

Fewer than 60 days: If you cancel fewer than 60 days before your scheduled arrival date, we’re sorry but we can not refund any money unless we are able to re-book the property to other renters during some or all of the days your booking was made for.

Refunds are usually done through Paypal or WISE and you are responsible for any occurring fees. For refunds done through other Banks you are responsible for any occurring banking fees. Your rental deposit is turned in to pesos at the moment of your payment, therefore the refund is sent back to you in pesos and then turned in to your bank’s currency. We aren’t responsible for the difference in the exchange rate there might be when doing a refund (we suggest to buy Travelers insurance).

In the event that you arrive later or must leave earlier than your scheduled dates, you will receive no refund for unused days.

Excluded from this policy are deposits stated as non-refundable in the reservation confirmation.

3. SECURITY DEPOSIT

La Manzanilla Homes may require a refundable security deposit, based on the total cost of your rental and length of your stay. The applicable amount will be included in your Reservation Confirmation email from us and is payable in full when you check in. This must be paid in cash and, in most instances, will be returned to you when you leave.

Exceptions to a full refund include applicable deductions for the following: loss of keys; damage to furnishings, the property or its surrounds; and any expenses incurred and outstanding when you leave. Should damages exceed the amount of your security deposit, you will be responsible for paying the excess amount prior to your departure.

If you leave without being checked out as arranged your entire security deposit will be held. This amount, less any applicable claims will be returned to you after a revision of the house by the owner or property manager. Judgment as to the condition of the property and the cost of damages or missing items is left to the sole discretion of the owner or property manager.

4. PRICES

Rates quoted are per home or number of persons and do not include taxes (3% ISH) unless otherwise listed in the Booking confirmation.

While market conditions may cause us to modify these rates, once your rental is confirmed the price of your stay is fully guaranteed as quoted.

Some of our rentals allow pets. If you wish to bring yours, you must make prior arrangements with us. A pet deposit might be required, depending on the animal and its size, and payable at check in.

Should you require services in addition to those stated for your rental – more frequent housekeeping, a cook, baby-sitter, etc. – you can expect to pay that person directly, in pesos. In addition, although not mandatory, your housekeeping staff always appreciates a tip (propina), usually left when you check out.

5. RESERVATION

On confirmation of the reservation by us, a deposit of 25% or 50 % (depending of the property) of the total amount issued in our confirmation is due immediately. Balance is due in full by arrival or 30 days before arrival date (depending on individual rental policies). At arrival we accept US$, CA$ and Mex. Pesos. We accept credit cards (Visa and MasterCard) via PayPal (at least 72 hours before arrival) but no private checks unless agreed on previously by La Manzanilla Homes!

In the case of short-term bookings, made less than 60 days prior to the arrival date, payment in full is due immediately. The deposit or payment must be done within 5 business days after the reservation has been confirmed. Payment must be done by wire transfer or via PayPal.com to

lamanzanillahomes@gmail.com. Any incidental charges such as bank transfer Fees, transfer taxes and PayPal fees will be added to each transaction to the total due by arrival.

Always quote the family name of the tenant and the date of travel and the name of the rental with any correspondence or payment. In case of your default of payment, either deposit or full payment for short-term bookings, within the terms of the above-mentioned deadlines, we consider the contract null and void automatically. In this case, we are released from any of our obligations. The reservation made for you will be eliminated.

6. COMPLAINTS

Any complaints concerning the accommodation must be reported to the house owner, his representative or to us and in writing within 48 hours of the complaint or dissatisfaction arising (e-mail: lamanzanillahomes@yahoo.com). We will, through our local agents, use our best efforts to arrange for these problems to be solved. Clients leaving the accommodation prematurely without express consent of La Manzanilla Homes lose all right to claim possible reimbursement. Complaints lodged at the end of the rental period will not be taken into consideration. Likewise, complaints made after departure from the accommodation cannot be verified and, therefore, cannot be considered for any possible reimbursement. Please note: Houses in Mexico are protected from current overload with breakers.

Although it happens very rarely, using too many appliances at the same time will shut off the house breakers. This does not mean that there has been a power failure, only that a breaker in the house has been triggered. It needs to be switched back on. Similar to the U.S. and other European countries, the panel is inside the house. Please be careful to limit the simultaneous use of electrical appliances. La Manzanilla Homes will not provide a refund if is lost temporarily due to a breaker being triggered or weather related reasons.

7. CHANGE OF LETTING PERIOD

If the accommodation or date of booking is changed after booking confirmation, this will be considered as a cancellation followed by a new booking unless otherwise agreed on.

8. NUMBER OF PERSONS

The total number of persons must not exceed the authorized number as stated in the web page description and repeated in the confirmation including children over the age of 5 years. Should the owner, his representative or the property manager find more persons than stated or paid for, it is up to his or our discretion to ask the clients to vacate the house. Pets are not permitted unless explicitly agreed to in writing. Should the owner or property manager find any violations to this clause, it is entirely up to her/his discretion to ask the client to vacate the house without compensation.

9. BEHAVIOR

It is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. In such circumstances the property owner/s and the Company have the right to terminate arrangements made on your behalf, in which case the Company’s responsibility to you ceases immediately and there can be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you will be liable to reimburse the

Company for any expenses whatsoever it incurs as a result of your behavior.

Breakages & Cleanliness:

Our accommodation is made available for letting on the understanding that the property will be left reasonable clean and tidy at the time of checkout. The customer will be held responsible for any damage or breakages to the property, caused by the customer and in the event of such occurrence, the incident must be reported to the owner or their representative immediately and an appropriate compensation made. Customers are not permitted to move any furniture or equipment without prior written consent from the property owner or La Manzanilla Homes. In the event of such permission being granted, it is the customers’ responsibility to return the same to its original position before checkout. Under no circumstances must any furniture or items for use inside the property, be moved outside.

10. RESPONSIBILITIES OF THE OCCUPANTS

The holiday home must be treated with care and respect. On departure, the accommodation must be left reasonably clean. The tenant is obliged to avoid or minimize any possible disruptions to services arising during his stay within the bounds of legal requirements.

11. LIABILITY

La Manzanilla Homes acts as the booking agent between the tenant and the owner of the property and can not be held responsible for the actions of either party or consequences there from.

We guarantee and vouch for:

– accuracy of rental agreement

– control and careful choice of accommodation

– accuracy of description of the accommodation

Under no circumstance shall La Manzanilla Homes be responsible for any personal loss by individuals renting the accommodations represented by us, expenses, claims, or injury, direct or indirect, caused or incurred before, during or after the party’s stay in the accommodations represented by us including attorney’s fees. La Manzanilla Homes will not be held liable and will be otherwise rendered harmless for any events arising in law as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of accommodations or services provided by us for reasons of military action, revolutions, terrorism and natural disasters. You agree to indemnify and hold La Manzanilla Homes harmless for any claims arising from a violation of the booking conditions of this agreement or of any third party claims. We solely have the full discretion to refuse or discontinue service to any person, and/or rescind any contract for accommodations of guest services. We will not be held liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services as described in these booking conditions. These booking conditions are the conditions by which will govern the reservations of all accommodations where we act as the representative and agent, unless otherwise provided. La

Manzanilla Homes will have sole discretion to determine choice of forum and law provisions.

12. ALTERATIONS AND CANCELLATIONS BY US

Though it is unlikely we will have to make any changes to confirmed arrangements, it does occasionally happen and we will advise you at the earliest possible date. If for some unforeseen reason a confirmed accommodation can not be provided because it is either destroyed, uninhabitable due to structural damage or essential equipment and fixtures such as electrical systems, plumbing, hot water being out of operation, or rented to another party by error or the property being sold to new homeowners, or is uninhabitable because it is not in working order per these booking conditions, La Manzanilla Homes will immediately attempt to find another accommodation of similar qualities, cost and size. The price difference, if greater, must be paid by you, and, if smaller, will be reimbursed by us. If it is not possible to offer an equivalent or the client refusing to rent the alternative accommodation, either side may terminate the booking contract. In this case the liability of La Manzanilla Homes is limited to the reimbursement of payments made by the client.

14. DISPUTE

Mexican legislation applies for the contractual relationship. Legal proceedings, arising out of, or in connection with this contract, which cannot be amicably settled, will be governed in all respects by the law of Mexico and all parties submit to the jurisdiction of local courts at all times. You acknowledge that you have received, understand and agreed to these booking conditions. On securing the booking the client and his/her party totally and unconditionally accepts these booking conditions.

15. GENERAL

Ineffectiveness of single clauses of these conditions do not automatically nullify the conditions in total.
